These Terms and Conditions govern the use of the Musk-IT website and the Musk-IT AI Project Execution Platform available at muskit.in. By accessing or using our platform, you agree to comply with these Terms. If you do not agree, you should not use the service.
Description of Service
Musk-IT provides a cloud-based software platform designed to support project execution management for EPC and infrastructure organizations. Features may evolve or change as the product develops.
- BOQ management and quantity tracking
- Execution dashboards with SPI, CPI and earned value analytics
- Resource planning and utilization monitoring
- AI-based analytics and delay forecasting
- Project monitoring, reporting and drawing control tools
User Accounts
To use certain features of the platform, users may need to create an account. Users are responsible for the following:
- Maintaining the confidentiality of login credentials
- All activities that occur under their account
- Providing accurate and up-to-date registration information
Musk-IT reserves the right to suspend or terminate accounts that violate these Terms or that are found to be misusing the platform.
Acceptable Use
Users agree not to engage in any of the following activities while using the Musk-IT platform:
- Using the platform for illegal or unauthorized activities
- Attempting to gain unauthorized access to platform systems or other user accounts
- Interfering with platform security, availability or functionality
- Uploading malicious software, harmful code or content that violates third-party rights
Intellectual Property
All software, technology, algorithms, user interface designs and platform content are the intellectual property of Musk-IT and its operators.
Users may not copy, reverse engineer, distribute, sublicense or reproduce any part of the platform or its underlying technology without prior written permission from Musk-IT.
Project Data
Users retain full ownership of all project data uploaded to the Musk-IT platform, including BOQ files, schedules, execution data and engineering documents.
By uploading data, users grant Musk-IT permission to process that data for the sole purpose of providing platform functionality including analytics, dashboards, AI forecasting and reporting. Musk-IT does not sell or share user project data with third parties.
Service Availability
We strive to maintain high system availability. However, Musk-IT does not guarantee uninterrupted access to the platform. Scheduled maintenance, software updates or unforeseen technical issues may occasionally cause downtime.
Enterprise clients with active SLA agreements are entitled to uptime guarantees and support response times as defined in their enterprise agreement.
Limitation of Liability
Musk-IT provides analytics, forecasts and execution insights to assist project management decision-making. All outputs are informational in nature.
Users are solely responsible for decisions made based on platform data. Musk-IT is not liable for project delays, cost overruns, financial losses or any outcomes resulting from decisions taken using the platform.
Subscription, Payments & Refunds
Certain services require a paid subscription, license, or project fee. Pricing, billing cycles and payment terms are specified on the Musk-IT licensing page or in the proposal or license agreement for your engagement. Online payments are processed securely through Razorpay; we do not store your card details.
For Enterprise and Source License plans, payment terms are agreed directly with the Musk-IT sales team and documented in the license agreement.
Refunds & cancellations. Initial consultations are free. Custom development and project work is quoted and billed against agreed scope and milestones; once work on a milestone has commenced, fees for that milestone are generally non-refundable, as they cover time and resources already committed. If you cancel a project before work on a milestone has started, any advance paid for that milestone is refundable less any costs already incurred on your behalf. Recurring subscriptions and managed-service plans may be cancelled with at least 7 days' notice before the next billing date; the current billing period is not refunded once it has begun. Specific refund and cancellation terms in a signed proposal or license agreement take precedence over this section.
Requesting a refund. To request a refund or cancellation, contact us at admin@muskit.in. We acknowledge requests within 3 business days, and approved refunds are returned to the original payment method via Razorpay, typically within 5–10 business days.
Termination
Musk-IT reserves the right to suspend or terminate access to the platform if users violate these Terms, engage in misuse, or fail to meet payment obligations under a subscription or license agreement.
Users may terminate their account at any time by contacting the Musk-IT team. Upon termination, users may request export of their project data within 30 days.
Changes to Terms & Governing Law
These Terms may be updated periodically to reflect changes in platform functionality, legal requirements or business practices.
Continued use of the platform after updated Terms are published constitutes acceptance of the revised Terms. Material changes will be communicated to registered users via email.
Governing law & jurisdiction. These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the competent courts of India. Where applicable, consumer rights under the Consumer Protection Act, 2019 and data rights under the Digital Personal Data Protection Act, 2023 are unaffected by this clause.
